Legal
Terms of service.
Effective November 2, 2026
1. Who we are and this agreement
Homefield Groundgame LLC, a Florida limited liability company, provides Groundgame, subscription software for running political campaigns. Homefield Groundgame LLC trades as Groundgame, a registered fictitious name. In these terms, "we" and "us" mean Homefield Groundgame LLC, and "you" means the person or organization using the service. If you accept for a campaign, committee or other organization, you confirm you have the authority to bind it.
By creating an account or using the service, you agree to these terms, and you grant us the licence to your data in section 7.
Homefield Groundgame LLC is wholly owned by Homefield LLC, a Florida limited liability company, the holding company that owns the software, the Groundgame name and the domains and licenses them to Homefield Groundgame LLC. "Affiliates" means Homefield LLC and any company it controls, directly or indirectly, now or later. Today the Affiliates are Homefield LLC and Homefield Groundgame LLC.
2. Eligibility
You must be at least 18 years old. The service is for lawful campaign and civic use by U.S. campaigns and political organizations, and we currently offer it in Florida only.
3. Subscriptions, billing and renewal
The plans, their prices and what each includes are on the pricing page. Payments are not yet live; until they are, nothing in the service charges you or collects a card. Published prices apply to every account: there are no trials, discounts, promotional rates or price locks. Taxes may apply.
Your paid plan renews automatically at the end of each billing period, each month or each year depending on the plan you choose, and you are charged for each new period until you cancel. We tell you before any renewal that follows a price change.
Candidate and Consultant plans bill monthly, with an annual option where the pricing page offers one. County plans have a 6-month minimum term: if you cancel before the end of the sixth month, you owe the payments remaining in the minimum term, and after that the plan is month to month. Statewide is billed yearly, in full, in advance.
Usage services, such as texting and mail, are charged by use on top of your plan, at the rate or quote shown to you before anything sends or prints.
4. Cancellation
You can cancel at any time from your account settings, online, the same way you signed up. No call or conversation is needed. Cancellation takes effect at the end of the period you have paid for; your access continues until then and you are not charged again. Cancelling does not delete your account or your data, and you can export your data before or after you cancel.
5. No refunds
All payments are final. We do not give refunds, full or partial, on any plan or usage service, except where the law requires one. That includes the first payment, the period in which you cancel, unused time, annual and Statewide payments, county minimum-term payments, and prepaid amounts when we end an account for a violation of these terms. Any refund the law requires goes back to the original payment method.
If the service is unavailable because of a failure that is our fault, we may give you a service credit against a future charge, at our sole discretion. A service credit is not a refund and not a promise. Nothing on the pricing page, at checkout or anywhere else promises more than this section.
6. Your account
Each account belongs to one organization: one candidate committee, one consulting firm with the client races it adds, one county party or other county organization, or one statewide organization. Your staff, volunteers and contractors working under your direction may use it, without limit. You may not give access, sign-ins or data from the service to anyone outside your organization, and a county account may not give them to candidate campaigns, which subscribe on their own plans.
7. Your data and our licence
What is yours. You own the data you bring into the service and the work you create in it. You may use it as you choose, subject to section 8 for voter data we supply, and you can export it, in an open format, at any time while your account is open, and on request for a reasonable period after it closes, within the export limits in section 8. You confirm that you have the right to upload everything you upload, including lists you bought or received from a party, committee or vendor, and to grant the licence below.
The licence you grant us. You grant Homefield Groundgame LLC and its Affiliates a perpetual, irrevocable, worldwide, royalty-free, transferable licence, sublicensable through multiple tiers, to host, store, copy, modify, adapt, combine, analyse, create derivative works from, use, license, sell and otherwise exploit everything you upload, enter or create in the service, including notes and other free text, and everything derived from it, for any purpose. That includes operating the service, training and improving our services and models, building and selling current and future products, and helping other customers' campaigns, including campaigns running against you in the same race. The licence applies to every account on every plan, and there is no opt-out. It survives cancellation, termination and deletion of your account. We keep your data and everything derived from it indefinitely. Deleting your account ends your access and removes your account from the service, but it does not withdraw the licence or oblige us to delete your data or unwind anything already derived from it.
Limits we keep. An Affiliate never receives more rights than we hold. Voter files carry permitted-use terms set by the state or county that issued them; those terms bind us and our Affiliates as well as you, wherever the data is held, and nothing in this section overrides them. No other customer, and no Affiliate, can sign in to your account or see your screens, lists, notes or plans through the service.
Where the law gives you more. If a law that applies to you gives you a deletion right that a contract cannot waive, the law wins: tell us which law, and we will carry out the deletion it requires, keep a record of it, and tell you plainly what was removed and what could not be.
8. Voter data rules
Permitted use. Voter registration data we supply comes from the Florida Supervisors of Elections and the Florida Division of Elections and is subject to Fla. Stat. 97.0585. You may use it only for purposes related to elections and political or governmental activities. Commercial use is prohibited, including marketing non-political goods or services, lead generation, skip tracing, background checks, identity verification, reselling or licensing the data, adding it to commercial datasets, and training models or products for non-political purposes. When you sign up, and for each client race a consultant adds, you certify that your use is for those purposes only.
Licensed, not sold. We license that data to you; we do not sell it. Your licence is non-exclusive and non-transferable and ends with your account. You may not redistribute, resell, sublicense, publish or post it, or any export containing it. You may give it to a vendor, such as a mail house or phone vendor, that acts only for you and for a political purpose, and you are responsible for how the vendor handles it.
Files you upload. You may upload and use a voter file only as its source permits. Getting it lawfully and staying within its permitted use is your responsibility.
Exports. Each paid plan has a monthly limit on how much voter data we supply may leave the service as files, as the pricing page states. Exports of your own uploads, and use inside the service, are not limited. We may raise these limits. County and Statewide accounts can ask for more, and a person decides each request. We log every export, and exports containing voter data we supply carry markers that identify your account; you agree to both. Automated extraction of any kind, such as scraping, bots, scripted bulk retrieval or slicing filters to rebuild the file, is prohibited whatever the limit.
People in the voter file. These protections apply on every account and plan, and no setting turns them off. Exact dates of birth never leave our servers; age appears only as a derived figure. Records exempt from public disclosure are left out of every contact list, export and other contact-shaped output, and every such output applies the suppression list for its channel (people who have opted out or asked not to be contacted).
Accuracy. Voter data is provided as received from official sources. We make no commitment about how often it is updated, and we do not warrant that it is accurate, complete or current.
Enforcement. If we decide in good faith that an account has used voter data commercially, broken its certification, redistributed data, used automated extraction or given access outside its organization, we may suspend or end the account immediately, without notice and without refund. If we do, your access and your licence to the data end, you must destroy all voter data we supplied and confirm that in writing within 10 days, and we may report the violation to the Supervisors of Elections, the Division of Elections or law enforcement where appropriate. We may audit export logs and account activity at any time, and you agree to cooperate reasonably with any investigation of misuse.
8A. Public-discourse analysis
Some features measure published news, government records and legislative records. Their publishers own them, we give you no rights in them, and a link takes you to the publisher, on the publisher's terms. You may use our measurements in your own work, but our citation of a source is not permission to republish it. Our figures cover only the sources and period they state; an absence in them is not an absence in the world, and nothing in them is a finding that a claim is true or false.
If you publish a source we read and want us to stop, write to [email protected]. We will stop collecting it and remove what we hold from it, and we will not ask you for a legal basis.
9. Acceptable use
Use the service only lawfully. In particular:
- Do not send communications that break the law or carrier rules, including consent rules for calls and texts (such as the TCPA and 10DLC registration), email rules and do-not-contact obligations.
- Do not try to get into another customer's account, probe or breach security, scrape the service, resell or sublicense it, or use it to build a competing product.
You are responsible for complying with election, campaign finance, communications, telemarketing, anti-spam (including CAN-SPAM) and disclaimer laws, and with the terms attached to your voter data. Features such as opt-out handling, quiet hours and disclaimer fields are tools, not legal advice: they do not move your obligations to us and do not ensure compliance, and where the law requires more than the service does, meeting it is your responsibility.
We may suspend or end an account used for unlawful outreach or misuse of the service (section 11).
10. Our property
Homefield Groundgame LLC and its Affiliates own the service, its software, its content other than your data and material owned by others, and the Groundgame name. These terms give you the right to use the service while they are in effect, and no other rights in it.
11. Termination
We may suspend or end your account for material breach of these terms, unlawful use, nonpayment or where the law requires; where practical, we will tell you first and give you a chance to put it right, except as section 8 allows. Sections 5, 7, 8, 10, 12 and 13 survive termination. Your right to export your data also survives, except where unlawful use means the law requires otherwise.
12. Disclaimers and limitation of liability
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that it will be uninterrupted or error-free, and we make no representation about any electoral result. Nothing in the service is legal advice.
To the maximum extent the law permits, our total liability arising out of or relating to the service is limited to the amounts you paid us in the twelve months before the claim, and neither party is liable for indirect, incidental, special, consequential or punitive damages.
13. Governing law and disputes
Florida law governs these terms, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or the service will be resolved in the state or federal courts in Pinellas County, Florida, and you and we each consent to those courts' jurisdiction. These terms contain no arbitration clause and no class-action waiver.
14. Changes and contact
We may change the service and these terms. We will give notice by email or in the service before a material change to these terms takes effect, and continuing to use the service after that date means you accept it. The current version is always on this page. Questions about these terms: [email protected].
